These Terms of Service ("Terms") govern your access to and use of the Ghost Drafter website located at www.ghostdrafter.co (the "Site") and the ghostwriting and manuscript drafting services offered by Ghost Drafter (the "Services"). By accessing the Site or engaging the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or engage the Services.Ghost Drafter is operated by Grimtithe AM Seller LLC, an Illinois limited liability company ("Company," "we," "us," or "our"). "You" or "Client" refers to any individual or entity accessing the Site or engaging the Services.1. Description of ServicesGhost Drafter provides professional ghostwriting and manuscript drafting services. We draft original manuscripts based on concepts, direction, outlines, and materials provided by clients. The specific scope, deliverables, timeline, and fees for each engagement are defined in a separate Ghostwriting Service Agreement executed between the Company and the Client. The Site provides general information about our Services, our process, and methods of contact. The Site does not constitute an offer to provide Services. Services are provided only pursuant to a signed Ghostwriting Service Agreement.2. Use of Artificial IntelligenceGhost Drafter utilizes artificial intelligence (AI) tools as part of its drafting and editorial process. AI is used to assist with, among other things, manuscript drafting, prose refinement, editorial review, and quality assurance. All AI-assisted output is reviewed, directed, and refined by human professionals before delivery to the Client. For a full description of how AI is used in our process, please review our AI Disclosure. AI-assisted drafting is integral to Ghost Drafter's process and cannot be excluded from any engagement. By engaging the Services, you acknowledge and accept the use of AI tools as described in our AI Disclosure.3. No Guarantee of ResultsGhost Drafter does not guarantee, warrant, or represent that any manuscript produced under the Services will be accepted for publication by any publisher, agent, or distributor; achieve any specific level of commercial success, revenue, or readership; win any award, recognition, or critical acclaim; be suitable for any particular market, genre category, or audience; or meet any subjective standard of quality beyond the specifications defined in the applicable Ghostwriting Service Agreement. The publishing industry involves inherent uncertainty. Our obligation is to deliver a professionally drafted manuscript in accordance with the agreed-upon specifications.4. Client ResponsibilitiesYou are solely responsible for all concepts, ideas, plots, characters, factual claims, and source materials you provide to us. You represent and warrant that you have the legal right to use all materials you provide and that such materials do not infringe upon the intellectual property rights of any third party. You are solely responsible for all decisions regarding the manuscript after delivery, including publication, distribution, marketing, and compliance with applicable laws.5. Intellectual PropertyAll intellectual property rights in any manuscript remain with Ghost Drafter until a separate Assignment of Intellectual Property Rights is executed upon receipt of final payment, as specified in the applicable Ghostwriting Service Agreement. Watermarked review copies provided during the engagement do not constitute a transfer of any rights.6. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GHOST DRAFTER AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THE SERVICES. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100.00). OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICES SHALL NOT EXCEED THE TOTAL FEES ACTUALLY PAID BY YOU UNDER THE APPLICABLE GHOSTWRITING SERVICE AGREEMENT.7. IndemnificationYou agree to indemnify, defend, and hold harmless Ghost Drafter and its owners, members, managers, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site; (b) the content, publication, or distribution of any manuscript after transfer of ownership; (c) any claim that materials you provided infringe upon the rights of any third party; or (d) your breach of these Terms.8. Disclaimer of WarrantiesTHE SITE AND ALL CONTENT THEREON ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.9. Governing Law and Dispute ResolutionThese Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in Cook County, Illinois, administered by the American Arbitration Association under its Commercial Arbitration Rules.10. Changes to These TermsWe reserve the right to modify these Terms at any time. Changes will be effective upon posting to the Site with an updated "Last Updated" date. How We Use Your InformationWe use the information we collect to: provide, maintain, and improve the Services; communicate with you about your engagement; process payments and maintain financial records; respond to inquiries and provide customer support; operate and improve the Site; comply with legal obligations; and protect against fraud and unauthorized access. We do not sell your personal information to third parties. We do not use your personal information for targeted advertising.3. Use of AI and Your DataGhost Drafter uses artificial intelligence tools in its drafting and editorial process. When AI tools are used in connection with your engagement, your Client Materials (concepts, outlines, notes, and other creative content you provide) may be processed through AI systems for the purpose of drafting, refining, and reviewing manuscript content. We do not use Client Materials to train AI models. The use of AI in your engagement is subject to the confidentiality provisions of your Ghostwriting Service Agreement and any applicable Non-Disclosure Agreement.4. How We Share Your InformationService Providers. We may share information with third-party service providers who perform services on our behalf, including payment processing, website hosting, and analytics.AI Tool Providers. Client Materials may be processed through third-party AI tools as described in Section 3. We select providers whose terms prohibit the use of input data for model training.Legal Compliance. We may disclose information if required by law, regulation, court order, or governmental request.Business Transfers. In the event of a merger, acquisition, or sale of substantially all assets, your information may be transferred as part of that transaction.5. CookiesThe Site uses essential cookies required for basic functionality and analytics cookies (such as Google Analytics) to understand how visitors interact with the Site. We do not use advertising or marketing cookies. We do not use third-party tracking cookies for targeted advertising. You may control cookies through your browser settings. Data RetentionClient Materials and manuscript drafts are retained for twelve (12) months following delivery of the Final Manuscript, then securely deleted unless otherwise agreed. Financial records are retained for seven (7) years as required by tax regulations. Website analytics data is retained for twenty-six (26) months. Communications are retained for twenty-four (24) months following the conclusion of the engagement. You may request deletion of your personal information at any time by contacting us at [email protected].8. Your RightsDepending on your jurisdiction, you may have the right to access, correct, delete, restrict, or port your personal information. To exercise any of these rights, contact us at [email protected]. We will respond to verified requests within thirty (30) days.9. California ResidentsIf you are a California resident, the CCPA/CPRA may provide you with additional rights, including the right to know what personal information we collect, the right to request deletion, the right to opt out of the sale of personal information (we do not sell personal information), and the right to non-discrimination for exercising your privacy rights. AI is not used for marketing claims, testimonials, or endorsements on behalf of Ghost Drafter.Human OversightEvery manuscript produced by Ghost Drafter passes through multiple stages of human review. AI is a tool in our process, not a replacement for professional expertise. Human professionals direct the creative vision, review all AI-assisted output, make all final editorial decisions, and ensure the manuscript meets the specifications defined in the Client's Ghostwriting Service Agreement.AI-Assisted Drafting Is Integral to Our ProcessAll Ghost Drafter engagements use AI-assisted drafting as a core part of the production process. Clients who are not comfortable with AI-assisted production are encouraged to seek a traditional ghostwriting service. By engaging Ghost Drafter, you acknowledge and accept that AI tools will be used in the drafting of your manuscript.Data HandlingClient Materials processed through AI tools are handled in accordance with our Privacy Policy and the confidentiality provisions of the applicable Ghostwriting Service Agreement. We don't offer unlimited revisions — one round is included, additional rounds are billed separately. We don't hide the AI.
